1. Overview
This website is operated by WOOREE PTY LTD, trading as Éclat d’être Australia (“Éclat d’être”, “we”, “us” or “our”).
Throughout these Terms of Service, the terms “you” and “your” refer to any visitor, customer or user of our website.
By visiting eclatdetre.com, using our website or purchasing a product from us, you agree to these Terms of Service, together with our Privacy Policy, Shipping Policy and Return and Refund Policy.
Please read these Terms carefully before using our website or placing an order.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
2. Eligibility
By using this website, you confirm that you are legally capable of entering into a binding agreement or that you have permission from a parent or legal guardian.
You must not use our products or website for any unlawful or unauthorised purpose.
3. Product Information
We make reasonable efforts to ensure that product descriptions, photographs, sizing information, colours and prices are accurate.
Colours and product appearance may vary slightly depending on lighting, photography and the display settings of your device.
Sizing and fit may vary between styles. Customers are responsible for reviewing the size guide and product information before placing an order.
We reserve the right to update product information, prices and availability without prior notice.
4. Product Availability
All orders are subject to product availability.
Placing an order does not guarantee acceptance of the order. An order is accepted when we send you an order confirmation or begin processing the order.
We may cancel an order where:
- an item is unavailable;
- there is an incorrect price or product description;
- payment cannot be authorised;
- we reasonably suspect fraud or unauthorised activity;
- delivery to the provided address is not available; or
- the order would breach an applicable law or restriction.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item or order to the original payment method.
5. Prices and Payment
Unless otherwise stated, all prices are displayed in Australian dollars.
GST is included where applicable.
Shipping charges, discounts and any other applicable charges will be displayed at checkout before payment is completed.
You agree to provide current, complete and accurate billing, delivery and payment information.
Payment must be successfully authorised before an order is processed.
Promotional codes and discounts:
- must be entered at checkout;
- cannot be applied retrospectively;
- may be subject to expiry dates, product exclusions or minimum purchase requirements; and
- cannot be exchanged for cash.
Only one promotional code may be used per order unless otherwise stated.
6. Orders
After placing an order, you should receive an order confirmation by email.
Please check your order details, delivery address, selected products, colours and sizes immediately.
Contact us as soon as possible at eclatdetreau@gmail.com if any information is incorrect. We cannot guarantee that an order can be changed or cancelled after processing has begun.
7. Shipping and Delivery
Orders are processed and delivered in accordance with our Shipping Policy.
Estimated processing and delivery times are provided as estimates and are not guaranteed. Delays may occur due to couriers, weather, customs, public holidays, high order volumes or other circumstances beyond our reasonable control.
Customers are responsible for providing a complete and accurate delivery address.
8. Returns, Exchanges and Consumer Guarantees
Returns and exchanges are handled in accordance with our Return and Refund Policy.
For eligible Australian orders, we offer one complimentary first size exchange, subject to the conditions stated in our Return and Refund Policy.
Change-of-mind rights do not replace or limit your rights under the Australian Consumer Law.
Where a product has a major failure, is unsafe, is materially different from its description or does not meet an applicable consumer guarantee, you may be entitled to a remedy under the Australian Consumer Law.
9. Overseas Fulfilment Products
Some products may be identified as Overseas Fulfilment products and may be dispatched directly by an overseas fulfilment partner.
Overseas Fulfilment products may:
- arrive separately from other items in the same order;
- have different delivery timeframes; and
- be subject to different change-of-mind return conditions.
Unless otherwise stated, Overseas Fulfilment products are not eligible for change-of-mind returns, refunds or exchanges.
This exclusion does not apply where a product is faulty, damaged, incorrect, materially different from its description or otherwise covered by the Australian Consumer Law.
10. Intellectual Property
Unless otherwise stated, all website content, including text, graphics, photographs, videos, logos, page designs and original promotional content, is owned by or licensed to Éclat d’être Australia.
You may access and use the website for personal, non-commercial shopping purposes.
You must not copy, reproduce, distribute, modify, republish, commercially exploit or create derivative works from our website content without prior written permission.
Product names, trademarks and logos belonging to third-party brands remain the property of their respective owners.
11. Reviews and User Content
When submitting a review, photograph, video, comment or other content, you confirm that:
- the content reflects your genuine experience;
- the content is accurate and not misleading;
- you have the right to submit the content;
- it does not infringe another person’s rights; and
- it is not unlawful, abusive, defamatory or inappropriate.
You grant us a non-exclusive, royalty-free permission to display, reproduce and use submitted content for operating and promoting our business, subject to applicable privacy and consumer laws.
We may remove content that breaches these Terms, but we will not alter a genuine review in a way that changes its meaning.
Where a reviewer received a complimentary or gifted product, this should be disclosed.
